§ 44-256. Enforcement.

  • (a)

    The county manager or his designee shall be responsible for the administration and enforcement of this article. It is specifically intended that the county may contract with a consultant and/or soil scientist to provide services hereunder.

    (b)

    Upon receiving a complaint or other information alleging a violation of this article or any complaint whatsoever regarding septage or sludge from a citizen of county, the county manager or his designee shall investigate the situation within 24 hours after receiving the report or complaint. If the county manager or his designee finds cause to believe that a violation exists of any state or federal law, rule, regulation or permit requirement, the county manager or his designee shall promptly notify the appropriate state or federal authority and shall use his best efforts to ensure that all state and/or federal laws, rules, regulations and/or permit requirements are properly enforced by the appropriate state or federal authority. All enforcement actions taken for a violations of any state or federal law, rule, regulation or permit requirement shall be enforced under applicable state or federal legal authority and the county manager or his designee shall initiate no duplicative civil or criminal proceedings under the authority of this article for violations of state or federal laws, rules, regulations or permit requirements.

    (c)

    If the county manager or his designee finds that a violation of a provision of this article has occurred, the county manager or his designee may take appropriate action as set forth in sections 44-257 and 44-258, below.
