§ 44-255. Reporting of land receiving sludge or septage.

  • To protect future landowners and the consumers of agricultural products grown upon land to which sludge or septage has been applied and as a condition of receiving a county permit under this article, each county permittee land applying or disposing of sludge or septage for which a state permit for the land application thereof is required shall file with the register of deeds office, so that it appears in the grantor index, owners' affidavits substantially in the form set out below describing each parcel of land receiving sludge or septage under said county permittee's permit. The county permittee shall file as many affidavits as are necessary to adequately describe the property upon which sludge or septage is being land applied. An owner affidavit must state the book and page number for the deed covering the property to which sludge or septage is to be applied under the terms of the county permit and shall state the name of the owner(s) of the parcel. A map must be attached to the affidavit and must be 8½ x 14 inches. The margin on the first page of the affidavit must be three inches from the top, with at least a ½ inch margin on each of the other three sides. Each subsequent page must have a minimum of a ½ inch margin on all four sides. The attached map must contain the following legend on the face of the map:

    THIS MAP IS NOT A CERTIFIED SURVEY AND HAS NOT BEEN REVIEWED BY A LOCAL GOVERNMENT AGENCY FOR COMPLIANCE WITH ANY APPLICABLE LAND DEVELOPMENT REGULATIONS.

    The county permittee shall pay all costs associated with recording said description. These costs shall be $14.00 for the first page and $3.00 for each additional page.

    The following is a sample affidavit of the type required by this section:

    AFFIDAVIT

    The undersigned, being first duly sworn, says that he/she/they are the owners of a certain tract or parcel of land situated in Granville County which is more particularly described in Deed Book _______, Page ______ of the Granville County, North Carolina Registry; and that sludge (or septage, as applicable) will be applied upon all or a portion of said lands which are more particularly described in the map annexed hereto as Exhibit "A" and incorporated herein by reference as if it were a part hereof. Owner understands that agents, employees, independent contractors, or others working for or on behalf of Granville County may enter upon Owner's land as described in the Granville County Sludge and Septage Ordinance.
